Our terms and conditions

These Terms include an arbitration agreement and a class-action waiver. Please read sections 12 and 13 carefully.
1. Acceptance of Terms
Using The Bored Plan (the “Service”) means you agree to these Terms of Service (“Terms”) and our Privacy Policy. If you don't agree, don't use the Service.
2. Description of Service
The Bored Plan is a community event discovery platform available in the United States. The Service allows you to discover local events, create and join community groups, plan activities, and connect with others. Event information is aggregated from third-party sources, user submissions, and automated scraping tools.
3. Eligibility & User Accounts
You must be at least 13 years of age to create an account. We do not knowingly allow children under 13 to register. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. See our Privacy Policy for how we handle personal information.
4. User Content & Moderation
By submitting events, group descriptions, photos, or other content (“User Content”), you grant The Bored Plan a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, modify (for technical purposes such as resizing or formatting), publicly display, distribute, and use such User Content for the purpose of operating, providing, promoting, and improving the Service. You retain ownership of your User Content. The license you grant terminates when you delete the content, except that (a) we may retain backup copies for a reasonable period, and (b) the license survives for User Content that has been shared with third parties until those copies are removed in the ordinary course.
User-submitted events are reviewed by automated tools (including Anthropic Claude) for moderation. We can remove, flag, or restrict content that violates these Terms or our community guidelines. We won't always notify you first.
5. Copyright and DMCA Policy
The Bored Plan respects intellectual property rights and complies with the Digital Millennium Copyright Act (“DMCA”). If you believe content on the Service infringes your copyright, send a notice containing the elements required by 17 U.S.C. § 512(c)(3) to our designated agent:

We will respond to valid notices and remove or disable access to allegedly infringing material. We will terminate accounts of repeat infringers in appropriate circumstances. To submit a counter-notice, follow the procedure in 17 U.S.C. § 512(g)(3). Misrepresentations in DMCA notices may result in liability under 17 U.S.C. § 512(f). 6. Event Information Disclaimer
The Bored Plan does not organize, host, or endorse any events displayed on the platform. Event information is aggregated from public sources (city tourism sites, chamber of commerce calendars, ticket platforms like Ticketmaster and SeatGeek, National Park Service event feeds) and user submissions. We do not guarantee the accuracy, completeness, timeliness, or reliability of any event listing, including dates, times, locations, pricing, or age guidance. You are solely responsible for verifying event details directly with the event organizer before attending. The Bored Plan shall not be liable for any losses, injuries, damages, or claims arising from your reliance on event information displayed on the platform.
7. Prohibited Conduct
You agree not to: (a) submit false, misleading, or fraudulent event information; (b) harass, threaten, or abuse other users; (c) scrape, crawl, or automatically collect data from the platform without authorization; (d) impersonate any person or entity; (e) use the Service for any unlawful purpose; (f) artificially inflate ad click counts or engagement metrics.
8. Subscriptions, Billing, and Refunds
Certain features (event promotion, business advertising) require paid one-time purchases or subscriptions processed through Stripe. Pricing, billing cycles, and refund eligibility are displayed at the time of purchase. You may cancel any subscription through your account settings.
All sales are final. We may issue a refund, at our discretion, if (a) a paid feature was unavailable for a substantial portion of its purchased duration due to our fault, (b) you were charged in error or duplicate, or (c) a refund is required by applicable law. Refund requests must be submitted to hello@theboredplan.app within 30 days of purchase. Initiating a chargeback before contacting us may result in account suspension.
9. Suspension and Termination
We may suspend or terminate your account or access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or abusive conduct, created legal risk for us or other users, or that suspension is necessary to protect the Service or its users. We may also terminate accounts that have been inactive for twelve (12) months. You may terminate your account at any time through your account settings or by contacting hello@theboredplan.app. Upon termination: (a) your right to use the Service ends immediately; (b) sections that by their nature should survive (User Content license, Disclaimer, Limitation of Liability, Indemnification, Governing Law) shall survive; (c) we may retain User Content and account information as required by law or our Privacy Policy; (d) prepaid amounts for unused, undelivered services will be refunded on a pro-rata basis unless termination was for your material breach.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
11. Limitation of Liability
To the maximum extent permitted by law, The Bored Plan and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
Our total cumulative liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100). Nothing in these Terms limits liability for (i) gross negligence, willful misconduct, or fraud; (ii) personal injury or death caused by our negligence; or (iii) liability that cannot be limited under applicable law. Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless The Bored Plan and its affiliates, officers, directors, employees, and agents from any third-party claims, losses, damages, liabilities, costs, and expenses (including reasonable attorney's fees) arising out of or relating to (a) your User Content, (b) your violation of these Terms, (c) your violation of any law or third-party right, or (d) your fraudulent or willful misconduct. This indemnity does not apply to claims arising from our gross negligence, willful misconduct, or breach of these Terms.
13. Governing Law, Arbitration, and Class Waiver
These Terms are governed by the laws of the State of North Dakota, without regard to conflict of law principles.
Any dispute arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall be conducted by a single arbitrator. The seat of arbitration shall be the federal judicial district where you reside, or, at your election, by video or telephone. The Bored Plan will pay all AAA filing, administrative, and arbitrator fees for any individual claim with an amount in controversy of $10,000 or less. You and The Bored Plan each waive the right to a jury trial and the right to participate in a class, collective, or representative action. If this class waiver is held unenforceable as to any claim, that claim shall be severed and brought in court; the remainder shall proceed in arbitration. Either party may bring an individual action in small claims court for any claim within that court's jurisdiction. Either party may seek temporary injunctive relief in any court of competent jurisdiction to protect intellectual property or confidential information pending arbitration.
14. Modifications
If we make material changes to these Terms, we will notify you by email at the address on your account at least thirty (30) days before the changes take effect, and by posting the updated Terms on the Service. Your continued use of the Service after the effective date constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service before the effective date.
15. Entire Agreement; Severability
These Terms, together with the Privacy Policy and any policies referenced herein, constitute the entire agreement between you and The Bored Plan regarding the Service and supersede all prior agreements. If any provision of these Terms is held to be invalid or unenforceable, such provision shall be modified to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
